These Terms govern use of the SchoolSawari platform — the mobile app used by parents, drivers and attendants, the School Admin web dashboard, and the API behind them (together, the "Service"), provided by SchoolSawari ("we," "us," "our").
By creating an account, logging in, or using the Service, you agree to these Terms. If you use the Service for a school, "you" also means that school, and you confirm you are authorized to bind it. For personal data, see our Privacy Policy.
1Who Can Use the Service
The Service has four roles:
- School Admin — school staff managing routes, rosters, drivers, students, billing and reports. Commercial matters (pricing, term, cancellation) are governed by the school's separate subscription agreement, which controls if it conflicts with these Terms.
- Driver / Attendant — staff or contractors authorized by the school to operate or attend a bus.
- Parent / Guardian — added by a school admin to follow their child's bus. Parents pay us nothing; access is part of the school's subscription.
- Platform Super Admin — SchoolSawari personnel who operate the platform, and who are not "customers" under these Terms.
Only schools can apply for the Service, by submitting an application from our website. An application is an enquiry, not an account: we may approve or decline it at our discretion, and nothing is provisioned until we approve.
Parent, driver and attendant accounts are created and removed by the school admin — you cannot self-register, and we cannot add or remove you on request. If your access is wrong, contact your school.
2Accounts and Credentials
- Parents sign in with a one-time passcode sent to the phone or email the school holds. Keep that number current with your school — it is your login identity.
- Drivers / attendants sign in with a PIN bound to one device. A new or replaced phone needs your admin to reset the binding. Do not share your PIN.
- School admins sign in with a password, plus two-factor authentication where enabled or required. Keep credentials confidential and tell us immediately if you suspect unauthorized access.
- We may rate-limit, lock, or require re-authentication on any account after failed attempts, on a device change, or where we consider it necessary for security.
You must accept the current version of these Terms and the Privacy Policy to continue using the Service. When we publish a new version, we will ask you to accept it at your next launch.
3Acceptable Use
You agree not to:
- Submit false attendance, false SOS or incident reports, or falsified trip data.
- Access another school's data, another parent's child, or another person's account.
- Interfere with, spoof, or simulate GPS tracking, notifications, or any safety feature.
- Reverse engineer, scrape, or access the Service by automated means outside the documented API.
- Use the Service for anything other than legitimate school transport coordination.
We may investigate suspected misuse and suspend access while we do.
4Tracking, Notifications and SOS — Important Limits
Read this section. It describes the limits of every safety-related feature.
- Live tracking is best-effort and depends on things we do not control — mobile coverage, GPS signal, device battery, and whether the driver's phone is on and the trip started. We do not guarantee uninterrupted, timely, or accurate real-time tracking.
- Arrival and proximity notifications are estimates, computed from GPS and past travel times. They may arrive late, early, or not at all. Do not use them as the sole basis for a safety decision.
- SOS is a message to the school, not an emergency service. It alerts the school's administrators and, if unacknowledged, escalates within the platform. It does not contact police, ambulance or fire. In a real emergency, call local emergency services first.
- Speeding, route and driving data are informational. They do not replace the school's own supervision of its drivers and vehicles.
- Detailed location history is short-lived. Full-resolution trails are thinned and then deleted on the schedule in the Privacy Policy. Trip reports and stop-arrival history are the durable record; raw GPS replay is not.
- The Service may be unavailable for maintenance, upgrades, or reasons outside our control, and we may change, add or remove features. We aim to give notice of planned maintenance where practical.
The Service supports transport coordination. It does not transfer responsibility for student safety or vehicle operation from the school, operator or driver to us.
5Responsibilities by Role
School admins are responsible for the data their school puts into the Service and for how their school uses it. That includes: keeping students, parents, drivers, buses and routes accurate and current, and deactivating people who have left; holding whatever consents the law requires before submitting anyone's personal data; using audit logs, attendance and reports lawfully; running the academic-year rollover and archival, and keeping any exports the school needs before archived records are removed; and keeping the subscription current. Access may be limited or suspended if a subscription lapses beyond any agreed grace period.
Drivers and attendants must use trip tracking only while on assigned duty, keep the device charged and connected during trips, use SOS only for genuine safety incidents, and follow their school's rules and traffic law regardless of anything the app displays.
Parents must keep the phone number on file current, mark absences honestly and within the school's cutoff, and treat bus location and arrival estimates as best-effort (see §4) and supplementary to their own arrangements with the school.
6Subscriptions, Billing and Fair Use
Schools are billed under their subscription agreement, which sets pricing, term, included volumes and payment terms. Where a plan includes an allowance for a metered item (for example SMS credits), usage beyond the allowance is charged at the rate in that agreement. Usage figures shown in the dashboard are our records and are what we bill from.
We may apply reasonable rate limits and technical quotas to protect the platform, and may contact a school whose usage is materially out of line with its plan.
7Data and Intellectual Property
The Service — its software, design, and underlying technology — belongs to us or our licensors. These Terms grant no rights to our source code, trademarks or branding beyond using the Service as intended.
Data you or your school submit (rosters, routes, trip records) remains yours. We process it under these Terms and the Privacy Policy, and we may use aggregated, de-identified data — from which no school, student, parent or driver can be identified — to operate and improve the Service.
8Suspension and Termination
- We may suspend or terminate access for breach of these Terms, non-payment, suspected fraud or abuse, or a security risk to the platform. Where practical we will give notice, but we may act first where the risk is immediate.
- A school may end its subscription per its subscription agreement. On termination we handle data as described in §5 of the Privacy Policy, including the window in which the school can export its records.
- Individual parent, driver and attendant accounts are deactivated by the school admin, not by the account holder and not by us.
9Disclaimers and Limitation of Liability
- The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and uninterrupted or error-free operation.
- As set out in §4, tracking, notifications and safety features are best-effort and depend on connectivity, GPS and third-party providers (mobile networks, SMS aggregators, push services) outside our control. We are not responsible for their failures.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits or data, including any arising from delayed, inaccurate or missing location updates, notifications or SOS delivery.
- To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the subscription fees paid by the relevant school in the twelve months before the event giving rise to the claim.
- Nothing here excludes liability that cannot be excluded under Nepali law, including for gross negligence or willful misconduct.
- Each school will defend and indemnify us against third-party claims arising from data it submitted without the required authority or consent, or from its own breach of these Terms.
10Governing Law, Changes and Contact
These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles, and the courts of Kathmandu have exclusive jurisdiction, unless a school's subscription agreement says otherwise.
We may update these Terms. We will change the "Last updated" date above and, for material changes, notify school admins through the Service or by email and ask affected users to accept the new version at next launch. Continued use after that constitutes acceptance.
If any provision is held unenforceable, the rest remains in force.
